Former President Donald Trump has formally requested an expedited ruling from the U.S. Supreme Court to overturn a federal appeals court decision that declared most of his tariff’s illegal.
The 7–4 ruling by the U.S. Court of Appeals for the Federal Circuit found that Trump overstepped presidential authority by imposing sweeping “reciprocal tariffs” under the International Emergency Economic Powers Act (IEEPA).
The court emphasized that tariffs are a core Congressional power, not a presidential one, and that Trump’s use of IEEPA to declare trade deficits a national emergency was unconstitutional.
The ruling is paused until October 14, giving time for the Supreme Court to decide whether to hear the case.
Trump warned that removing tariffs could turn the U.S. into a “third-world country,” claiming the stock market dip was a direct result of the ruling.
His administration argues that the tariffs are essential to protecting American industry and national security.
